The Union Council of India authorized a 10% quota for the Economically Weaker Section (EWS) in government positions and educational institutions in the General category on January 7, 2019. The cabinet agreed that this would be in addition to the existing 50% reserve for SC, ST, and OBC groups.
The Constitution (One Hundred and Twenty-fourth Amendment) Bill, 2019, was introduced in the Lok Sabha, India’s lower house, on January 8, 2019, and was passed the same day. On January 9, the Rajya Sabha, India’s upper parliament, enacted the bill. On January 12, 2019, President Ram Nath Kovind signed the bill into law, and it was published in the Gazette.
It became legislation as a result of this action. The Constitution of India’s One Hundred and Third Amendment, which went into effect on January 14, 2019, altered articles 15(6) and 16(6) to allow for 10% reservations for the EWS category. Several state governments have accepted the law and stated that the 10% EWS reservations will be implemented.
The proposed amendment was challenged in the Supreme Court of India on 10 January 2019 by Youth For Equality, an NGO that opposes caste-based policies, on the grounds that it violates the 50 percent reservations ceiling set by the same court. The group said it fully supports EWS reservations but wants them to be implemented by converting the existing 27 percent OBC quota into an economic means-tested non-caste-based quota.
Thereby staying within the apex court’s 50 percent limit Leaders of Backward Classes welfare organizations, on the other hand, contacted the Supreme Court, alleging that EWS groups did not fit the reservations requirements that the same court had established in a previous case. The Supreme Court rejected to halt the GEN-EWS category’s 10% reservation in government positions and educational institutions on January 25, 2019. The court agreed on a five-member bench to hear the case on August 6, 2020.
